Welcome to 121 Training Pty Ltd trading as 121 Driver Training. By accessing our website (www.121drivertraining.com.au) and/or enrolling in our courses, you agree to the terms and conditions set forth in this document. We advise that you read them thoroughly. We reserve the right to modify and update these Terms and Conditions at any time without prior notice. It is your responsibility to review these Terms periodically for updates.
1. ACCEPTANCE OF TERMS
By accessing our website or signing up for our services, you agree to be bound by these terms and conditions and all applicable laws and regulations.
2. SERVICES OFFERED
We provide a range of driver training programs and services in accordance with the revised Standards for Registered Training Organisations (RTOs).
3. PREFERRED TRAINER
If participants have a preferred trainer in mind, we will make every endeavour to accommodate such preferences. However, due to scheduling, availability, or other unforeseen circumstances, we cannot guarantee assignment to a specific trainer. We appreciate your understanding and assure you that all our trainers are highly qualified to provide the best training experience.
4. RIGHT TO REFUSE SERVICE AND BEHAVIOUR POLICY
a. Service Discretion: We reserve the right to refuse service to anyone for any reason at our discretion.
b. Behaviour Towards Staff: We maintain a zero-tolerance policy towards abusive, aggressive, or inappropriate behaviour. Individuals displaying such behaviour may be removed and services may be terminated without a refund.
5. CANCELLATION/REFUND POLICY
a. Withdrawal and Fees: Should a student withdraw:
– After enrolment but before copyrighted training material is issued: A $250 administrative fee is payable.
– After training material issuance: 50% of the course fee is payable.
– More than 14 days post material issuance: The full course fee is payable.
b. Terms and Conditions for Refunds: All withdrawal and refund requests must be in writing to the CEO of 121 Driver Training, detailing student info, course details, and the reason for the refund request.
c. Postponements/Cancellations by 121 Driver Training: If we need to postpone or cancel a course or module due to unforeseen circumstances, we’ll inform students 48 hours prior. If an alternative date isn’t suitable for the student, a full refund for that course or module will be provided. We guarantee to complete training within 12 months of a student’s start date. If not, we’ll cover the costs of an alternative RTO to finish the training.
6. DEBT RECOVERY
a. Outstanding Fees:
Students must ensure that all course fees and charges are paid by the due date provided on their invoice or as agreed at the time of enrolment. Failure to pay fees may result in the suspension or termination of enrolment and access to training services.
b. Acceleration of Debt:
If a student has multiple invoices issued and defaults on any one of them, all outstanding invoices and future scheduled payments shall become immediately due and payable in full, regardless of their original due dates.
c. Debt Collection Action:
If any amount remains unpaid after reasonable attempts to collect payment, 121 Driver Training reserves the right to initiate formal debt recovery proceedings, including engaging a registered debt collection agency.
d. Liability for Recovery Costs:
The student acknowledges and agrees to be liable for any and all reasonable costs incurred in recovering overdue payments. This may include, but is not limited to, debt collection fees, legal fees, court costs, and administrative charges.
e. Impact on Credit:
Where applicable, overdue debts may be reported to credit reporting agencies, which could negatively impact the student’s credit rating.
7. PRICE BEAT GUARANTEE
At 121 Driver Training, we are committed to offering the best value for our training courses. If you find a lower price on an identical accredited course from another Registered Training Organisation (RTO) within Australia, we will not only match that price but also beat it by $100.
a. How to Claim:
- Proof of Lower Price: You must provide a verifiable and current advertisement, written quote, or other proof showing the same course for less, from another RTO. The proof must include the date, price, and significant details of the course.
- Claim Submission: Submit your claim within 7 days of enrollment or before the course starts, whichever is earlier. Claims can be made by contacting our support team.
b. Terms and Conditions:
- Eligibility: The price-beat guarantee applies to accredited courses that are identical in duration, content, and certification. The competitor’s course must be available at the time you make your claim.
- Exclusions: This guarantee does not apply to:
- Courses where the lower price is due to typographical errors.
- Unaccredited courses or from non-Registered Training Organisations.
- Courses from private providers not recognised by Australian educational authorities.
- Promotions involving rebates, coupons, or special membership prices.
- Courses part of a limited-time offer, daily deal, clearance, or flash sale.
- Limitations: The guarantee is limited to one claim per course, per student.
- Payment of the Difference: The $100 difference will be refunded to you within 30 days of the claim being verified and approved by our team.
- Other Promotions: This guarantee cannot be combined with any other promotional offer or discount.
- Right to Modify or Discontinue: 121 Driver Training reserves the right to modify or discontinue the price-beat guarantee at any time without prior notice.
8. INTELLECTUAL PROPERTY
All content, including course materials and website information, are the property of 121 Training Pty Ltd. Unauthorised reproduction or distribution is prohibited.
9. SMS MESSAGING PROGRAM TERMS
a. Program Description:
Upon opting into our SMS messaging program, you will receive messages related to our services, such as course updates, promotional offers, and reminders. Message frequency may vary based on your preferences and our services.
b. Opt-Out and Cancellation:
You can cancel the SMS service at any time by simply texting “STOP” to the shortcode provided in the messages. Once you text “STOP,” we will send you a confirmation SMS to confirm that you have been unsubscribed. After this confirmation, you will no longer receive SMS messages from us. To rejoin, sign up as you did initially, and we will resume sending SMS messages to you.
c. Support for Messaging Program:
If you experience issues with the messaging program, reply with the keyword “HELP” for more assistance, or reach out directly to our support team at [email protected].
d. Carrier Liability:
Please note that carriers are not liable for delayed or undelivered messages.
e. Message and Data Rates:
Message and data rates may apply for messages sent to you from us and to us from you, as per your wireless provider’s terms. For questions about your text or data plan, please contact your wireless provider.
10. PRIVACY POLICY

11. GOVERNING LAW
These terms are in accordance with the laws of New South Wales, Australia. Participants submit to the exclusive jurisdiction of the courts in New South Wales.
